After some hearing, Mr. Chinmoy Pradip Sharma, learned Senior Counsel for the plaintiff, on instructions, seeks permission to withdraw the present suit with liberty to institute a fresh suit after taking steps for pre-institution mediation in accordance with Section 12A of the Commercial Courts Act, 2015.

The suit, alongwith all pending applications, is dismissed as withdrawn with liberty as aforesaid.

Having regard to the fact that the suit has been withdrawn at the threshold, the Registry is directed to refund the court fees deposited by the plaintiff.
