% 27.01.2020 Learned counsel for petitioner has not disputed the fact that coaccused is on bail, who actually committed alleged rape and has married with prosecutrix and staying with her as husband and wife. The alleged role of petitioner is that when prosecutrix was raped, petitioner was driving car in which the prosecutrix was raped by co-accused (now husband). In view of the above, on parity and without commenting on merits of the case, I am of the view that the petitioner is entitled for bail. Accordingly, he shall be released on bail on his furnishing personal bond in the sum of ₹20,000/- with one surety of the like amount to satisfaction of the Trial Court.
Present petition is allowed and disposed of.
