The present petition has been filed under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter, referred to as the 'A&C Act'), whereby the petitioner seeks interim directions restraining the respondent from creating third party interest or parting with possession of the subject property/basement till the conclusion of the Arbitration. 2.

In view of the orders passed in ARB.P. 1804/2024 and the fact that the dispute between the parties have already been referred to the learned Sole Arbitrator, let the present petition itself be treated as an application under Section 17 of the A&C Act and decided accordingly by the learned Arbitral Tribunal.
