Through the present petitions filed under Section 447 of Bharatiya Nagarik Suraksha Sanhita, 2023, the Petitioners seek transfer of cases enumerated below:

Mr. Ravi Prakash, Senior Counsel for the Petitioners, states that the Petitioners in the afore-mentioned transfer petitions are related to each other. He urges that there is a commonality in the facts in the present case as the accused, who is the brother of Ms. Rajshree Singh, is common in all the petitions. He submits that in order to avoid any conflicting views, it would be appropriate in case all the cases are heard and decided by the Saket Court. 3.

Mr. Sudhir Nandrajog, Senior Counsel for the Respondent, although opposes the petitions and states that he is not averse in case all the matters are clubbed before one Court. However, he states that the first complaint was filed before the Patiala House Court and therefore, he submits that all cases could be directed to be placed before the same Magistrate as per Section 142(1) of the Negotiable Instruments Act, 1881. 4.

Considering the foregoing, the present petitions are allowed and it is directed that CC No. 6073/2022 and CC No. 6073/2022 pending before the Saket Courts, shall stands transferred to Patiala House Court. All the cases shall be heard by the same Court.

The Copy of this order shall be communicated to Principal and District Sessions Judge, Patiala House Court for reference. 6.
