The accused/applicant seeks regular bail in case FIR No. 106/2022 of Police Station Special Cell for offence under Section 21/61/85 of NDPS Act. 1.1 This application for the first time came up for hearing on 10.01.2025 before the predecessor bench. Thereafter, the application remained pending before different benches and finally alongwith 179 such old pending bail applications this application also was transferred to this bench. 1.2 Today is the first hearing before this bench. 2.

After addressing partly, learned counsel for accused/applicant, on instructions, seeks permission to withdraw this bail application with liberty file afresh before the trial court after testimony of the witnesses from FSL and the concerned Home Department, who permitted interception of phone and who forensically examined the allegedly intercepted telephone conversation between the accused/applicant and co-accused Rajesh Gupta.
