% 10.01.2018 The petitioner corporation takes exception to the impugned order dated 27.12.2017 on the contention that it was passed by the Municipal Taxation Tribunal exercising powers under the Contempt of Court Act which did not vest in it, the action having been initiated on the basis of contempt petition no. MA No 8/MTT/2017 filed by the respondent.

The learned counsel for the respondent who has appeared on advance notice submits that the amount payable by the petitioner corporation has already been received pursuant to the direction in the earlier order of the Tribunal and, therefore, the application on the basis of which the impugned order was passed is not pressed, though the respondent reserves the right to rake up the issue of interest before the Tribunal by proper proceedings.

The counsel for the respondent, on instructions, undertakes to make a statement before the Tribunal not to press the application for Contempt on the basis of which the impugned order was passed. In this view of the matter, the learned counsel for the petitioner submits that she does not press the petition for any further relief. The petition along with accompanying application stand disposed of accordingly.
