Ms. Sheyl Trehan, Senior Counsel for Petitioner, on instructions, states that in view of the judgment of the Supreme Court in Rakesh Bhanot v. M/s Gurdas Agro Pvt. Ltd.,1 she would like to withdraw the present petition without prejudice to her rights and contentions and seeks liberty to urge all the grounds raised in the instant petitions before the Trial Court in accordance with law.

Counsel for Respondents, on the other hand, oppose the permission to withdraw as the Petitioners have been enjoying the stay in the matters. 3.
In response, Ms. Trehan, clarifies that the position in law which existed prior to the clarity given by the Supreme Court in the aforesaid decision entitle the Petitioner to seek a stay. 4.
Considering the above, the leave and liberty as prayed for are granted. It is clarified that the Court has not commented on the grounds urged in the present petition and all rights and contentions of the parties are left open. Needless to say, the Trial Court shall decide any grounds, if raised by the Petitioner, having regard to the judgment of the Supreme Court, in accordance with law.
