The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter, 'the Act') seeking appointment of a Sole Arbitrator to adjudicate the disputes arising from the work executed under agreement no.48/EE/PWD/SR-II(M-411)/2019-20. The clause providing for arbitration is Clause 25 of GCC. 2.

The petitioner gave a notice dated 24.11.2025. However, it appears that notice is not in terms of Section 21.

Mr. Vijay Kumar, learned counsel for the petitioner, faced with this situation, seeks to withdraw the present petition and file fresh petition after giving notice in terms of Section 21 of the Act. 4.

In view of the above, the petition is dismissed as withdrawn with liberty as aforesaid.
