3. The present application has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking extension of furlough for a period of four weeks in light of the medical ailments of the petitioner.

4. Issue notice.

5. Learned Additional Standing Counsel accepts notice on behalf of the State.

6. As per order dated 12.01.2026, the petitioner was granted a further period of two weeks, on the same terms and conditions as imposed by the competent authority vide order dated 24.12.2025.

7. The request for the extension of furlough for a period of four weeks is opposed by the learned Additional Standing Counsel who submits that as per rules the maximum period to which furlough could be granted has already been granted and therefore, no further extension may be granted by this Court.

8. The learned counsel for the petitioner quite persuasively argues that the period may be extended and he draws the attention of this Court to Medical Certificate dated 16.01.2026 (Annexure A-4) as per which the petitioner has been advised follow up after two weeks to review the outcome of the surgery that he had undergone and for evaluation.
