% 20.03.2019 An ad-interim maintenance order dated 27.02.2018 passed by the Metropolitan Magistrate on her petition (CC No.1444/2017) in favour of the petitioner is under challenge by Criminal Appeal No.22/2018 (266/2018) in the court of Additional Sessions Judge (ASJ), the said appeal having been preferred under Section 29 of Protection of Women from Domestic Violence Act, 2005 belatedly, the appeal having been entertained subject to costs of Rs.15,000/- as per order dated 06.10.2018, it being assailed by the present petition under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.), the contention being that the delay was unexplained and should not have been condoned.
The respondent has entered appearance through counsel on being served. The counsel on both sides having been heard, it is now agreed that the petitioner does not press the present petition, her only request being for a CRL.M.C. 54/2019
direction to the appellate court for rendering expeditious decision on the appeal in a time bound manner, the counsel on both sides assuring and undertaking that they would render full cooperation. The first appellate court where the appeal is pending is requested to decide the appeal expeditiously, preferably within three months of 28.03.2019, which is the date stated to be next fixed in the matter. The petition is disposed of in above terms.
