O R D E R

% 09.01.2019 Respondent no.2 is present in the court and has been identified by ASI Dhyan Singh of police station CAWC / Nanak Pura. Respondent no.2 submits that she has settled the matter with petitioner no.1 of her own free will and without any undue force, pressure or coercion vide Settlement Agreement dated 4th September, 2017. Marriage between respondent no.2 and petitioner no.1 has already been dissolved by a decree of divorce by mutual consent on 28.04.2018 by the Family Court, North-West, Rohini Court, Delhi.

Petitioner no.1 has paid `1,25,000/- to respondent no.2 today in Court by way of demand draft. Respondent no.2 submits that she has received the entire settled amount and has no objection

in case FIR No. 33/2008 under Sections 406/498A/34 IPC registered at Police Station CAWC/Nanak Pura, Delhi is quashed against petitioner no.1 and his relatives i.e. petitioner nos. 2 to 4. Keeping in mind settlement arrived at between petitioner no.1 and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
