The above Bail applications have been filed in FIR No.499/2024 under Section 110/115(2)/3(5) BNSS Police Station D.B.G. Road by the Petitioners/Applicants Sameer S/o Taufiq, Gaurav S/o Harish, Mohit S/o Harish, Taufiq S/o Buddhan and Sameer S/o Mohd. Nashir, seeking Regular Bail.

It is submitted that the injured and the accused are all neighbours and a fight had taken place between them resulting in registration of cross FIR No.499/2024 in which the Applicants are the accused and the FIR No.500/2024 against the Complainants in the present case. It is submitted that the accused Sameer S/o Taufiq, Gaurav and Mohit are in Judicial Custody since 02.11.2024 and accused Taufiq and Sameer S/o Mohd. Nashir are in Judicial custody since 04.11.2024. It is further submitted that the Charge Sheet already stands filed and the accused may be admitted to bail.

The Bail of the accused persons is opposed on the ground that the crime is heinous. If Bail is granted, there is a likelihood of them committing the same offence again, since they are neighbours. Accused Sameer has previous involvement in FIR No.181/2020 under Section 307/323/34 IPC P.S. DBG Road.

As per the case of the Prosecution, a fight had taken place between the accused and the injured parties and the cross FIRs were registered. chargesheet has already been filed.

Considering the totality of circumstances, the accused persons namely Sameer S/o Taufiq, Gaurav S/o Harish, Mohit S/o Harish, Taufiq S/o Buddhan and Sameer S/o Mohd. Nashir are granted Regular Bail, on the following terms and conditions:
a) The petitioners/accused shall furnish a personal bond of Rs.25,000/- and one surety each of the like amount, subject to the satisfaction of the learned Trial Court.
b) The petitioners/accused shall appear before the Court as and when the matter is taken up for hearing;
c) The petitioners/accused shall provide their mobile number/changed mobile number to the IO concerned which shall be kept in working condition at all times;
