The present bail application has been filed under Section 439 Cr.P.C. seeking regular bail in FIR No.229/2018, under Sections 15/61/85 NDPS Act registered at Police Station Kirti Nagar, Delhi. 2.

Learned counsel for the petitioner submits that the petitioner is in judicial custody since 24.06.2018. He submits that so far only one witness out of total 13 witnesses has been examined. He further submits that as per the FIR, there were two cars at the spot and the patrolling party was interrogating the occupant of the other car bearing CH-03U-6123 and that the petitioner has been falsely implicated in the present case. 3.

Learned APP for the State, on the other hand, has opposed the bail application. She submits that the petitioner's application has been recently dismissed vide order dated 20.09.2019. In the present case, when the patrolling party tried to enquire from the petitioner, he tried to run away but BAIL APPLN. 3154/2019

was caught at the spot. The car bearing No. HR-26AV-1074 is registered in the name of the present petitioner and from the dickey of the said car, a quantity of about 45 kg. of doda has been recovered. 4.

In view of the above facts and circumstances of the case, I am not inclined to admit regular bail to the petitioner. The same is dismissed. MANOJ KUMAR OHRI, J FEBRUARY 19, 2020 na BAIL APPLN. 3154/2019
