The above Bail applications have been filed in FIR No.500/2024 under Section 110, 3(5) BNSS Police Station D.B.G. Road by the Petitioners/Applicants Asharfi Lal S/o Rama Shankar, Suraj Bhan S/o Kali Charan, Sunil Kumar S/o Suresh Kumar, Jatin S/o Diwan chand and Nitin S/o Amarjeet, seeking Regular Bail.

It is submitted that the injured and the accused are all neighbours and a fight had taken place between them resulting in registration of cross FIR No.500/2024 in which the Applicants are the accused and the FIR No.499/2024 against the Complainants in the present case. It is submitted that the accused Asharfi Lal S/o Rama Shankar, Suraj Bhan S/o Kali Charan, Sunil Kumar S/o Suresh Kumar, Jatin S/o Diwan Chand and Nitin S/o Amarjeet are in Judicial Custody since 02.11.2024. It is further submitted that the Charge Sheet already stands filed and the accused may be admitted to bail.

The Status Report has been filed on behalf of the State, wherein it is submitted that chapad was recovered from accused Sunil and Hammer from accused Jatin. There were five injured persons out of whom MLCs were prepared of the injured, Mohit, Taufiq, Sameer and Sama Parveen. The nature of injuries of Mohit and Sameer were found Simple, while for the nature of injury of Taufiq, the Doctor statd that "Final opinion cannot be given as the patient had absconded".

The Bail of the accused persons is opposed on the ground that the crime is heinous. It is contended that if Bail is granted, there is a likelihood of them committing the same offence again, since they are neighbours. 5.
Submissions heard and record perused.

As per the case of the Prosecution, a fight had taken place between the accused and the injured parties and the cross FIRs were registered. Chargesheet has already been filed.

Considering the totality of circumstances, the accused persons namely Asharfi Lal S/o Rama Shankar, Suraj Bhan S/o Kali Charan, Sunil Kumar S/o Suresh Kumar, Jatin S/o Diwan chand and Nitin S/o Amarjeet are granted Regular Bail, on the following terms and conditions: a) The petitioners/accused shall furnish a personal bond of Rs.25,000/- and one surety each of the like amount, subject to the satisfaction of the learned Trial Court.
b) The petitioners/accused shall appear before the Court as and when the matter is taken up for hearing.
c) The petitioners/accused shall provide their mobile number to the IO concerned which shall be kept in working condition at all times and in case of change of the mobile number, it shall be intimated to the Investigating Officer concerned.
d) The petitioners/accused shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses.
e) That in case of change of their residential address, the same shall be intimated to the Trial Court, and to the concerned I.O. 8.
