Petition under Section 11(4) and (6) Arbitration and Conciliation Act, 1996 has been filed on behalf of the petitioner for appointment of Arbitrator to adjudicate the disputes and the claims of the petitioner in accordance with the Arbitration and Conciliation Act, 1996.

An objection has been taken on behalf of the respondent that in terms of clause 67.3 of the Agreement inter se the parties they had agreed that in case of disputes, they shall approach ICC for resolution of disputes. 3.
Since the petitioner has not approached the forum agreed to, the present petition is not maintainable.

Learned counsel appearing on behalf of the petitioner wishes to withdraw the present petition and seeks permission to withdraw.
