O R D E R

% 08.01.2020 Learned Sr. Counsels appearing for the parties state, all the three petitions can be disposed of by relegating the parties to the process of arbitration. They state, all these petitions be directed to be treated as applications under Section 17 of the Arbitration and Conciliation Act, 1996 . They also state, for convenience, the parties shall file the pleadings as filed before this court before the learned Arbitrator. Further, they left it to the court to appoint a Sole Arbitrator.

If that be so, this court appoints Ms. Justice Manju Goel, a retired Judge of this Court as the Sole Arbitrator to adjudicate the disputes and differences between the parties. The appointment of Justice Manju Goel shall be regulated by the Rules of the Delhi International Arbitration Centre. These petitions shall be treated as applications under Section 17 of the Arbitration and Conciliation Act, for which purpose, the parties shall file the same before the learned Arbitrator. Learned counsel for the parties shall be at liberty to appear before Justice Manju Goel on January 11, 2020 after taking prior appointment on her mobile number being 9818000330. It is also agreed by the counsel for the parties that the interim order passed on December 17, 2019 in OMP (I) (COMM). 467/2019 and the

statement made by the counsel for M/s. Rugby Renergy Pvt. Ltd. in OMP (I) 512/2019 shall continue till the parties appear before the learned Arbitrator on January 11, 2020. Their statements are taken on record. Replies to the applications shall be filed by the opposite party on or before January 9, 2020.

The petitions stand disposed of.

IA. 134/2020 in OMP (I) (COMM) 467/2019 Dismissed as infructuous.

A copy of this order be given dasti under the Signatures of the Court Master.
