The present application has been filed praying for interim bail for the petitioner in connection with FIR No.
300/2023 under Sections 364A/302/201/120B/34 IPC read with Sections 25/27 of Arms Act registered at Police Station Ambedkar Nagar.

Notice in this matter was issued on 10.01.2024 with a direction to the State to file a status report.

The learned counsel for the petitioner submits that while in jail the petitioner was found to be suffering from Recurrent GCT Proximal Tibia. 4.
He submits that the petitioner was admitted in the MAX Hospital, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
Saket on 12.12.2023 where the petitioner underwent a surgical procedure and was thereafter discharged on 20.12.2023.

He invites the attention of the Court to the discharge summary of the petitioner dated 20.12.2023 to contend that post surgery the petitioner has been advised to maintain hygiene and care of plaster. It has also been advised by the doctor that special care is required. Attention of the Court is also drawn to the medical status report received from the jail. 6.
A perusal of the medical status report shows that post surgery also the petitioner has been regularly visiting the MAX Hospital. He has visited the MAX Hospital, Saket on 02.01.2024, 09.01.2024 and 16.01.2024. It thus appears that sustained post operative care is required. 7.
In view of the above, I am of the view that the petitioner is entitled to interim bail on medical ground for a period of four weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs.25,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall not leave Delhi/NCR without prior permission of the Court.
b) Petitioner shall appear before the Court as and when the matter is taken up for hearing.
c) during the period, the petitioner is on interim bail, he shall telephonically apprise about his treatment to the IO concerned on every Saturday.

e) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the complainant and other witnesses.
