This hearing has been conducted through hybrid mode. CM APPL. 490/2026 (for stay of impugned order) 2.
The present application has been filed by the petitioner under Section 151 of the Code of Civil Procedure, 1908 seeking stay of the operation of the impugned order dated 16th October, 2023 and the execution proceedings. 3.
Mr. Shekhar Gupta, learned counsel for the respondent appears on advance notice and accepted notice.

Learned counsel for the respondent submits that the matter is listed before the Executing Court for 19th January, 2026 and that the recovery amount is Rs. 38,65,349/-.

Perusal of the record shows that vide order dated 20th August, 2025, the execution proceedings have been stayed, subject to deposit of 50% of the decretal amount. has been dismissed in default. The petitioner has also not deposited the 50% of the decretal amount in compliance of the order dated 20th August, 2025. 6.
Keeping in view the conduct of the petitioner, at this stage, this Court does not find any ground to grant the stay of the execution proceedings. Accordingly, the application stands disposed of. CM APPL. 80666/2025 (for recalling of order dated 17th November, 2025) 7.
