% 08.05.2026 I.A. 12973/2026 (Urgent listing of the Suit) 1.

This is an application under Section 151 of the Code of Civil Procedure, 1908, seeking urgent listing of the Suit on the ground that the parties have been able to resolve their disputes amicably under the aegis of the Delhi High Court Mediation and Conciliation Centre.

Notice is accepted by Mr. Jaydeep Roy, learned counsel accepts notice and states that the application may be allowed. 4.

In view of the above, the application is allowed and disposed of. CS(COMM) 17/2026 5.

reduced into writing vide the Settlement Agreement dated 29.04.2026. 6.

The terms of the Settlement are recorded in para 1 to para 31 of the present application.

The Settlement Agreement dated 29.04.2026 is taken on record. 8.

In terms of para 20 of the present application, the defendant no.1 shall provide documentary proof to the plaintiff of all cancellation/withdrawals referred in the Settlement Agreement, including para 7, 12, 16 and 19. It is also a condition in para 20 that every such compliance shall be reported within seven (7) days of such cancellation/withdrawal taking effect. 9.

The learned counsel for the defendant states that the terms provided in para 20 shall be earnestly implemented.

Parties shall remain bound by the terms of Settlement. 11.

Let a decree sheet be drawn up in terms of the Settlement Agreement dated 29.04.2026.

Court Fees shall be refunded to the plaintiff in terms of Section 16 of the Court Fees Act, 1870 read with the Court Fees (Delhi Amendment) Act, 2026, upon completion of all the formalities, as per Rules. 13.

The Suit is decreed and disposed of alongwith all the pending applications, if any.

14.

Next date before Joint Registrar (Judicial) i.e. 08.07.2026 and before the Court i.e., 09.09.2026 stand cancelled.
