% 06.05.2016 Respondent has been served. He does not wish to file reply. After some arguments, it has been agreed that the impugned order be set aside. Parties are siblings. They are closely related. This Court has been informed that the two witnesses on behalf of the petitioner/defendant already stand examined. Learned counsel for the petitioner under instructions states that she will examine two more witnesses, one is private witness and one will a summoned witness. Evidence by way of affidavit of the private witness already stands filed. The same shall be taken on record. Copy of the same be furnished to the learned counsel for the respondent. DW-3 will be present in Court on the next date for cross-examination. The Court shall grant no unnecessary adjournment and the summoned witness shall also be present for a date after the examination of DW-3 stands concluded on the petitioner/defendant taking appropriate steps. At the cost of repetition, it is reiterated that the Trial Court shall give no

unnecessary adjournments. This order is passed subject to payment of Rs.3,000/- as costs.

Petition disposed of.
