By way of the present application, decree holder seeks withdrawal of the present execution petition in view of the settlement agreement dated 24.02.2026.

The lawyers are abstaining from work. Mr. Gurmeet Singh, learned proxy counsel appearing on behalf of the decree holder, on instructions, submits that the present execution petition has been filed by the petitioner seeking execution and the implementation of interim order / judgment dated 29.03.2023 passed in FAS (OS) (COMM) 296/2018 and FAO (OS) (COMM) 297/2018 read with order/judgment dated 13.02.2015 passed in CS (OS) 1045/2014 (later renumbered as CS (COMM) 769/2016). 3.

He submits that during the pendency of present petition, parties arrived at settlement, terms whereof have been recorded in the form of settlement agreement dated 24.02.2026, and the suit has been decreed in terms thereof. The execution petition is thus, dismissed as withdrawn. 5.

At this stage, learned counsel appearing on behalf of the decree holder/applicant submits that the immoveable properties of the judgment debtor were attached by this Court vide order 10.01.2024 read with order dated 25.01.2024. Attention of the Court has been invited to Para 25 to 27 of the order dated 25.01.2024.

He urges the Court that the immoveable properties of the judgment debtor may be released from attachment.

Accordingly, following immovable properties are released from the attachment:

(i). Freehold land with Building at A-61, Okhla industrial Area, Phase II, New Delhi-110020;

(ii) Leasehold Land with Building at Phase-I, Lane No. 5, SIDCO Industrial Complex, J & K-181133;

(iii) Leasehold Land at D-205, Sector-63, Noida; and; (iv) Land and Building at KH. NO. 1747/1274/1-19, 1277/3-0, 1278/1-18, DEHLA ROAD, VILLAGE & P O MANPURA TEHSIL BADDI, Himachal-173205 8.

Application stands disposed of.
