% 16.09.2020 Hearing has been conducted through Video Conferencing. CM No. 22863/2020 This is an application seeking condonation of delay of 13 days in filing the Review Petition.

For the reasons stated in the application, the same is allowed. Delay of 13 days in filing the Review Petition is condoned. Application is disposed of.

REV. PET. 135/2020 This is a petition filed by the Respondent/College seeking review of the direction in para 38 (2) of the judgment dated 27.07.2020 to the extent of grant of 9% interest to the Petitioner from the date the University approved the grant of benefits of 7th CPC to its teaching Faculty.

Learned counsel for the Respondent/College submits that as far as the Petitioner is concerned, he had fulfilled the requisite formalities for grant of the benefits of the Pay Commission only on 17.07.2019. Additionally, it is also submitted that the College had referred the matter to the University for approval, which is still pending and therefore, the College cannot be penalized by way of the interest, more particularly, from the date the benefits were approved by the University and at best the Petitioner shall be entitled to interest from 17.07.2019. Issue notice.

Mr. Joby P. Varghese, Advocate accepts notice on behalf of the Petitioner and seeks a period of one week to file reply to the petition. Let reply be filed within a period of one week from today. Rejoinder, if any, be filed within one week thereafter.
