Petitioner has approached this Court challenging the Show Cause Notice dated 26.12.2023, proposing action for revocation/impounding of the Passport of the Petitioner. The Show Cause Notice reads as under: "

You may recall that passport no. 25533708 was issued to you from this office on 05.08.2019 on the basis of passport application form submitted by you. It has come to notice of this office that FIR no. 443/2023 is registered against you U/s 408 IPC, which acts the provision of section 10(3)(e) of The Passports Act, 1967.

You are, therefore directed to show cause in writing as to why your passport should not be impounded/ revoked u/s 10(3)(e) of The Passports Act, 1967. Your response should reach to this office within 15 days of receipt of this letter, otherwise this office The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. will presume that you have no reasons to dispute the proposed act and necessary action as deem fit in this regard will be taken u/s 10(3)(e) of The Passports Act, 1967.

You are therefore, advised to submit your passport no. Z5533708 in original along with your response on the issue. Your response should reach to the undersigned within 15 days of receipt of this notice on any working day between 10.00AM to 01.00PM" 2.

Learned Counsel for the Respondent states that the Respondents do not propose to take any action against the Petitioner on the ground that the proceedings against the Petitioner are only at the stage of registration of an FIR and the charge-sheet has yet not been filed. 3.

The Writ Petition is disposed of along with the pending applications, if any.

Liberty is granted to the Petitioner to approach this Court if need arises in future.
