In furtherance of last order of the predecessor bench, nominal roll was received from jail. Learned ASC submits that in view of the nominal roll, now there is no impediment to allow the present petition. 2.

The petitioner has sought quashing of order dated 24.12.2024 passed by the respondent whereby his request for first spell of furlough for a period of three weeks was rejected on the ground that on the earlier occasion, after availing furlough from 17.11.2023 to 01.12.2023, the petitioner surrendered after delay of seven days, so punishment was recorded. 3.

According to the nominal roll, the said punishment of stoppage of mulakats was not approved by the Principal District and Sessions Judge (Headquarters). That being so, as fairly submitted by learned ASC, the impugned order cannot be sustained.

Under these circumstances, the petition is allowed, thereby setting aside order dated 24.12.2024 passed by the respondent. case FIR 136/2008 of PS Tilak Nagar, the petitioner is granted first spell of furlough for three weeks commencing from date of his release subject to petitioner furnishing a personal bond of Rs. 10,000/- with one surety in the like amount to the satisfaction of the concerned Jail Superintendent. 5.

Copy of this order be sent to the Jail Superintendent for immediate compliance.
