Mr.Amit Goel, Adv.

versus THE COMMISSIONER OF POLICE & ORS.

..... Respondents Through:

Mr.Amish Dabas, Adv. for R-1 & 2.

Ms.Garima Prashad, Standing Counsel for SDMC.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 11.01.2019 1.

The short grievance as articulated by the learned counsel for the petitioner is that there are some unauthorised barriers/poles erected near the entrance of the public road on the south side of the petitioner/ school in Srinivas Puri for the last many years, thus, making it very difficult for the buses of the school to turn while entering the school. 2.

Learned counsel for the petitioner states that the petitioner has approached all the respondents by sending repeated letters and legal notices, but has received no response thereto except from respondent no.2 who has simply washed away his hands by saying that the matter does not pertain to the Traffic Police.

3.

Today, learned counsel for the respondent nos.1 and 2 appearing on advance notice assure the Court that they will

expeditiously consider the issue raised by the petitioner in its various representations/letters and legal notices by convening a meeting of all the stakeholders including the petitioner and the RWA at whose behest the poles are stated to have been erected. In view of the aforesaid statement of learned counsel for respondent nos.1 and 2, learned counsel for the petitioner states, on instructions, that, at this stage, the petitioner would be satisfied if the petition is disposed of with directions to the respondent nos.1 and 2 to decide its representations in a time bound manner.

4.

Accordingly, the petition is disposed of with a direction to the respondent nos.1 and 2 to examine the petitioner's representations and pass a reasoned order thereon within a period of eight weeks and communicate the same to the petitioner. In case the petitioner is aggrieved by the decision taken by the respondent nos.1 and 2, it will be open for the petitioner to take legal recourse as per law. 5.

The petition is disposed of along with the pending application. REKHA PALLI, J JANUARY 11, 2019 gm
