This hearing has been done through hybrid mode. 2.

The present petition under Section 12 read with Section 2(b) of the Contempt of Courts Act read with Article 215 of the Constitution of India seeks following prayers:- "(i) Pass an order allowing the present application and holding that the Defendant and its partners and its authorised signatory HASHIMBHAI IBRAHIMBHAI TAMBOLL, ASLAM HASHIMBHAI TAMBOLI, ROSHANBANU HASHAM BHAI TAMBOLI and IBRAHIMBHAI HASHIMBHAI TAMBOLI have clearly violated the undertaking and order dated 18th January, 2017 passed by this Hon'ble Court in CS (COMM) No.

1090 of 2016 thereby holding the Contemnors to contempt; (ii) and An order detaining the Contemnors in civil prison; and (iii) An order directing the Contemnors to file affidavits listing out their assets so that appropriate orders may be passed attaching the said personal property / assets of the Contemnors; and (iv) Pass an order of interim injunction directing the Contemnors to immediately appear before this Hon'ble Court in-person and comply with the undertaking and order dated 18th January, 2017 and to withdraw all the trademark applications as mentioned in the lists filed along with the present application; and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(v) Summon the Contemnors and/or any other concerned partner of the Defendant concern, who is instrumental in the performance and operation of the day-to-day affairs of the Defendant concern to explain and file reply as regards the submissions made by the Petitioner in the instant petition regarding the involvement of the Contemnors in the acts of contempt; and (vi) An order awarding appropriate compensation / costs to the Petitioner in light of the Contemnors' illegal and infringing activities; and (vii) Pass further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the instant case in favour of the Petitioner."

Learned counsel appearing on behalf of the petitioner submits that the matter has been settled and seeks leave to withdraw the present petition. 4.
