O R D E R

Pursuant to the order passed by this Court on 30th April, 2025, an affidavit dated 7th May 2025 has been filed on behalf of the defendant giving details of its existing stock of the products bearing the impugned mark 'ARENON'.

In view of the fact that the defendant does not wish to contest the present suit on merits, a decree of permanent injunction is passed in favour of the plaintiff and against the defendant in terms of prayer clauses 80 (a), (b), (c), (e) and (f).

Counsel for the defendants seeks and is granted six (6) months' time to exhaust the existing stock of the products bearing the impugned mark 'ARENON' as disclosed in the affidavit dated 7th May 2025. The defendant shall take steps to change the corporate name of the defendant company so as to remove the name 'ARENON' as a part of the defendant's name, within two weeks from today. 5.

Further, in terms of prayer clause 80 (d), a direction is issued to the defendant to withdraw the trademark applications bearing no. 6446081 and 6446082 within two weeks from today.

Counsel for the plaintiff does not press for reliefs prayed for in prayer clauses 80 (g), (h), (i), (k) and (l).

Counsel for the plaintiff does not press the relief prayed for in prayer clause 80 (j) in the present suit, while seeking the liberty to assert this prayer in appropriate proceedings.

7.1 The aforesaid liberty is granted, and the right of the plaintiff to get its mark 'LA RENON' declared as 'a well-known mark' is kept open for appropriate proceedings.

Let the decree sheet be drawn up in the above terms. 9.

All pending application(s) stands disposed of. 10.

Since the matter has been settled at the initial stage itself, the Registry is directed to issue a certificate of refund of 100% of the Court Fees in favour of the plaintiff in terms of Section 16 of the Court Fees Act, 1870.
