O R D E R

Order dated 22nd August 2023, on the basis of which contempt petition has been filed, has since been modified by order dated 20th October 2023.

Based on the directions orders in Seema Chopra v Government of NCT of Delhi W.P. (C) 10749/2023, directions have been passed on 20th October 2023. It later transpired that vehicle had already been scrapped prior to order dated 20th October 2023.

The Court clarified on 29th April 2024 that order of 20th October 2023 does not apply, since the vehicle had already been scrapped. 4.

Counsel for the respondent-Transport Department reiterates her submission that the department is required to wait only for 90 days after The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. impounding the vehicle, and as on the date of order dated 20th October 2023, the said period had already expired and vehicle was, accordingly, scrapped.

Counsel for Nirvana Scrappers, respondent no.3, drew attention to decision dated 16th May 2024, in Geeta Narula v. GNCTD and ors. in W.P. (C) 15637/2023 and other connected matters, and states that while dealing with issue of compensation and scarp value of vehicles which have been scrapped, it was directed that owners are entitled to scrap value of respective vehicles and said is to be released to them (owners) on their approaching the concerned RVFS (in this case respondent no.3) with relevant documents establishing their ownership of the vehicle and bank account details.

Accordingly, on petitioner approaching the respondent no.3 with requisite documents and bank account details, respondent no.3 shall remit the scrap value to petitoners, forthwith, and also intimate the petitioners methodology used by them in arriving at the scrap value. 7.

Counsel for the petitioners asserts for compensation in this regard. 8.

As stated in decision in Geeta Narula (supra), the right of compensation will have to be asserted through appropriate proceedings. 9.

Liberty is therefore granted to petitioners in this regard. 10.

No further directions are required to be passed. 11.

Accordngy, this contempt petition is disposed of in above terms. 12.
