O R D E R

Learned counsel for respondent No. 3 (Delhi Police) submits since that the status report had been filed yesterday only, the same might be still not on record.

However, during course of consideration, a spare copy has been shown to the Court and copy thereof, has also been provided to learned counsel for petitioner.

It has been submitted by learned counsel for respondent No. 3 that the Cart in question had been seized under Section 66 of Delhi Police Act, 1978 as it was found in no-vending area and was also against the terms of the certificate of vending (CoV).

It is, however, submitted that there is already a direction by the concerned ACP to release the above said cart and the petitioner herself has not come to collect the same. Such cart is still with the police, lying in Malkhana of the concerned Police Station.

When asked, learned counsel for respondent No.3 also informed that there is no requirement of depositing any fee or penalty and petitioner can always come and collect the above said cart.

Learned counsel for petitioner submits that without prejudice to her rights and contentions, she would collect the same from the respondent. She also submits that, in case, she finds that some damage has been caused to her cart and some goods have been misappropriated, she be granted liberty to file appropriate petition seeking appropriate relief. 7.

Such liberty is always available to her.

Learned counsel for petitioner also prays that direction be given to respondents to not interfere in her vending activity, particularly, when she vends strictly as per the conditions given in certificate of vending. 9.

Learned counsel for respondents, on instructions, submit that there is no question of any kind of interference as long as the petitioner complies with the conditions given in the certificate of vending. 10.

It seems that in view of the above, no further action is, therefore, required in the present petition.

Learned counsel for petitioner also submits that she does not seek any further relief, at the moment.
