O R D E R

% 17.02.2020 This bail application has been filed by applicant/petitioner u/s 439 Cr.P.C. for grant of bail in FIR No. 167/2018 for the offences punishable u/s 307/506 IPC registered at P.S. Vasant Vihar, Delhi. For the same relief, petitioner approached Trial Court and vide order dated 13.05.2019 his application was dismissed by observing that there is a strong apprehension that, petitioner, if enlarged on bail, may again threaten the complainant and the victim.

It is not in dispute that petitioner had been granted interim bail on three previous occasions and there was no complaint against him for advancing threat either to complainant or victim during that period. The allegations of threat were made at the time of incident, however, not later on.

Petitioner is in custody since 25.05.2018.

However, without commenting upon merits of case, I am of the view that the present case is fit for bail. Therefore, petitioner shall be released on bail on his furnishing a

personal bond in sum of ₹25,000/- with one surety of the like amount to the satisfaction of the Trial Court.

The present bail application is allowed and disposed of. Copy of this order be transmitted to the Jail Superintendent and Trial Court concerned for compliance.
