% 07.01.2020 Learned counsel for the petitioner submits that the petitioner has written a letter dated 03.01.2020 to the Chief Engineer, Northern Construction/Special Northern Railway, Kashmere Gate, New Delhi for consideration of its proposal for extension of period for performance of the contract and the same is under active consideration with the respondent. Learned counsel for the respondent does not deny the fact that the proposal is under consideration.

In view of the said development, learned counsel for the petitioner, on instructions from the petitioner, seeks leave to withdraw the petition. Leave granted.

Petition is disposed of as withdrawn along with the pending application.
