We have heard Ms Arundhati Katju at some length in support of the appeal.

We indicated to Ms Katju that apart from anything else we find no reason to interfere with the impugned judgment, for the reason that the mother is, at the moment, in custody of three girls aged approximately 19, 17 and 12 years and all of them are suffering from one or other disability. 3.

Having regard to this aspect of the matter, we had asked Ms Katju to take instructions as to whether she would like to press the appeal. Ms Katju, on instructions, says that given the concern expressed by the Court vis-à-vis the children, the appellant/husband does not wish to press the appeal. The appeal is, accordingly, dismissed as withdrawn. 5.

At this stage, Ms Katju says that the timeframe for paying the arrears qua the maintenance be extended. We are informed that the arrears have to be paid within four (4) months from the date of impugned judgment dated 20.11.2023.

We have put this suggestion to the counsel for the respondent/wife. Based on the consent arrived at between the counsels, the following directions are issued vis-à-vis extension of time for payment of arrears: (i) 50% of the arrears will be paid within four (4) months commencing from 20.12.2023.

(ii) The remaining amount will be paid within two (2) months thereafter. 7.

Resultantly, the pending applications stand closed. RAJIV SHAKDHER, J.
