The present petition has been filed under Article 226/227 of the Constitution of India seeking as under:

"i) Issue a writ of mandamus directing the respondent the respondents to finalize & implementation of the draft scheme/policy for revitalization of RTV buses operated as Stage Carriage buses and to implement the same in a time bound manner, and; ii) Issue a writ of mandamus directing the respondents, to include RTV operators in the km scheme; and iii) Issue a writ of mandamus directing the respondents for extension of permit for a period for further 5 years under Stage Carriage i.e. from 1 0 to 15 years; and iv) Issue writ of mandamus directing the respondents, to waive stand fees for RTV operators for extended period of 2 1⁄2 year." Learned counsel for the petitioner submits that the draft scheme/policy for revitalization of RTV buses operated as Stage Carriage buses has been prepared but the same has not been implemented. 3.

The draft scheme has been annexed as annexure P-5 to the present petition.

Learned counsel for the petitioner submits that grave prejudice and hardship has been caused to the petitioner and other similarly situated persons as a result of the non- implementation of the said scheme. 5.

Issue notice.

Learned counsel, as aforesaid, appears and accepts notice on behalf of the respondents.

After some hearing, the learned counsel for the petitioner submits that the respondents be directed to treat the present petition as a representation, and take an appropriate decision thereon within a period of six weeks from today, after affording an opportunity of hearing to the petitioner. It is directed accordingly.

The present petition is, accordingly, disposed of in above terms. 9.

In case, the petitioner remains aggrieved with the outcome of the aforesaid exercise, he shall be at liberty to approach this court and/ or avail appropriate remedies.
