It is not in dispute that an application, i.e., CM No.41728/2022 was preferred by the appellant to seek intervention in the matter. The appellant, admittedly, was not a party to the writ petition. 3.

According to us, the appellant cannot have a better right than those who were parties to the writ action and, therefore, be given a right to file an appeal.

The appellant was heard by the learned Single Judge in its capacity as an intervener.

5. Accordingly, this appeal is closed with liberty to the appellant to make submissions before the court, with regard to the issue at hand. 6.

Thus, the learned counsel who appears on behalf of the respondent, i.e. Syndicate Innovations International Ltd. [i.e., the original writ petitioners] will furnish a copy of the case papers to learned counsel, who appears on behalf of the appellant, in the above-captioned appeal. 7.

Consequently, the pending applications shall stand closed.
