Having heard the learned counsel for the parties and on perusal of the record, it appears that Arbitration has been invoked at the behest of the appellant in terms of the Memorandum of Understanding dated 08.08.2017, the parties are already appearing before the learned Sole Arbitrator.

Accordingly, the present appeal is disposed of without prejudice, meaning thereby that the issues which are raised in the present appeal shall not bar the continuation of the arbitral proceedings and the entire gamut of the dispute between the parties shall be decided by the learned Sole Arbitrator in accordance with law.
