O R D E R

% 28.11.2017 CM No. 43295/2017 This is an application under Section 151 CPC filed by the respondent seeking release of an amount in favour of the respondent as per the order dated 04.01.2017.

Learned counsel for the respondent has submitted that a sum of Rs.1,00,000/- be released in favour of the respondent and not the entire balance amount of Rs.3,00,000/- which has been kept separately in the form of three FDRs amounting to Rs.1,00,000/- each, as per the order dated 04.01.2017. Learned counsel for the petitioner has no objection to this effect.

In view of the submissions made and cause submitted in the application by the respondent, an amount of Rs.1,00,000/- with cumulative interest, if any, as per rules, of the first FDR be released in

favour of the respondent on completing the necessary formalities by the bank.

Accordingly, the application stands disposed of. Dasti.
