This is an application filed on behalf of the Petitioner under Section 439 Cr.P.C. for grant of Regular Bail in case FIR No.882/2015 dated 10.09.2015 registered under Sections 302/307/34 IPC at PS: Nihal Vihar. 2.

Counsel for the applicant seeks to withdraw the present application but seeks a direction to the Trial Court to expedite trial since the applicant is under incarceration for the last 8 years. It is submitted that co-accused has been arrested 5 years after his arrest and has been granted bail by the Trial Court. Mr. Yudhvir Singh Chauhan, learned APP draws the attention of the Court to the order granting bail to the co-accused and states that the role ascribed to him was different and this fact is noticed by the Trial Court while dismissing applicant's bail application. 3.

Without adverting to the merits of the case, the application is dismissed as withdrawn. Trial Court is requested to expedite the trial considering that only formal witnesses remain to be examined and applicant is in judicial custody since for over 8 years.
