IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 165/2019 MOHD SALIM ..... Petitioner Through:

Mr. Vishal Raj Sehijpal and Mr. Sunil Sagar, Advs.

versus THE STATE ( GOVT OF NCT DELHI) & ANR..... Respondents Through:

Ms. Manjeet Arya, APP for State with SI Sumit, P.S. Jamia Nagar.

Respondent no.2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 15.01.2019 It is submitted that petitioner and respondent no.2 are known to each. A quarrel took place between them on some trivial issue which led to registration of FIR No. 439/2013 under Sections 392/506/34 IPC at police station Jamia Nagar, on the complaint of respondent no.2. It is further submitted that with the intervention of their common friends and family members, petitioner and respondent no.2 have settled their disputes amicably vide Settlement/Compromise Deed dated 28.05.2014, therefore, aforesaid FIR may be quashed.

Respondent no.2 is present in Court and has been identified by SI Sumit of police station Jamia Nagar.

He submits that he has settled the matter with petitioner of his own free will and without any undue force,

pressure or coercion, therefore, he has no objection in case the aforesaid FIR is quashed.

Keeping in view that petitioner and respondent no. 2 are known to each other and a quarrel took place between them on some trivial issue which led to registration of present FIR and that they have settled their disputes amicably, in my view, no fruitful purpose would be served in keeping the criminal proceedings.

Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.

A.K. PATHAK, J.
