FAO(OS) 7/2016 & CM No.506/2016 (stay) This is an appeal against the order dated 18.11.2015 passed in IA No.23313/2015 under Order XXXIX Rules 1 & 2 CPC. An ad-interim injunction has been granted by the learned Single Judge staying the auction. The application, however, has not yet been disposed of by the learned Single Judge and he has listed the same for arguments on 08.02.2016. Since the application would be taken up for hearing on 08.02.2016 and the date of the auction has already gone by, we are not inclined to interfere

with this order. It is hoped that the learned Single Judge shall take up the application for arguments on 08.02.2016 and shall dispose the same. In this view of the matter, we are not interfering with the impugned order. The appeal stands disposed of. We are making it clear that we have not made any comments on the merits of the matter.
