This hearing has been done through hybrid mode. 2.
The present petition under Section 2(b) of the Contempt of Courts Act seeks following prayers:- "i) pass an order and hold that the Respondent is guilty of willfully disobeying the order dated 23.08.2023 passed in WP No. 11144 of 2023 and initiate contempt proceedings against the Respondent and punish them in accordance with the law; and / or ii) any other order that the Hon'ble Court deems fit in the circumstances for the interest of justice."

Learned counsel appearing on behalf of the respondent has placed on record a compliance affidavit, wherein it has been recorded as under:- "3. That this Hon'ble Court by order dated 23.08.2023 directed the answering Respondent to dispose of the fresh representation/application after giving personal hearing to the petitioner and pass a detailed and reasoned order in accordance with law within 6 weeks.

hearing to the Petitioner, wherein the petitioners have demanded that they have to be paid timely increments. However as per the point 8 of tenns of engagement letter "No additional/ extra allowances or remuneration will be paid to you.for discharging the assigned additional" work of additional duty assigned to you as and when required". Therefore, it is clear that the petitioners are not eligible for any increments. Copy of the engagement letter is annexed as Annexure-"A".
5. That after giving the personal hearing, the Answering Respondent herein have passed a detailed Order dated 31.01.2024 in due compliance and same was served to the Petitioner on the same day. The Order dated 31.01.2024 is annexed as Annexure-"B"."

Learned counsel appearing on behalf of the petitioners no. 1 to 5 and 8 and learned counsel appearing on behalf of the petitioners no. 6,7 and 9 submit that they have received the speaking order and seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law before the Court of competent jurisdiction with respect to the said speaking order.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
