O R D E R

This is a petition seeking grant of anticipatory bail in FIR No.284/2024 dated 28.04.2024 registered at PS Dayal Pur, North East District, Delhi under Sections 307, 427 and 34 of IPC.

As per the FIR, it is alleged that on 27.04.2024 at around 02:00 AM, the complainant parked his car in front of a shop - JS Electricals. 3.

On 28.04.2024 at around 11:30 AM, when the complainant went to get his car, the owner of the shop picked up a fight with the complainant. The complainant was assaulted and beaten with an iron rod and a sharp object by the owner of the shop and his associates (7-8 boys).

Hence, the present FIR was registered by the complainant. 5.

The role attributed to the petitioner is that the complainant was hit with fists and blows by the petitioner.

In the present case, the petitioner was granted interim protection on 15.01.2025. Pursuant to the same, the petitioner joined investigation and is cooperating with the same.

Three of the accused persons have been granted regular bail in the present FIR. 8.

Additionally, the nature of injuries suffered by the complainant is opined to be simple.

Since the accused persons have already been granted bail and since the petitioner is cooperating in the investigation, I am inclined to allow the present petition. Keeping in view the aforesaid facts and circumstances of the present case, the present petition is allowed.

It is directed that in the event of arrest, the petitioner be released on bail subject to his furnishing a personal bond in the sum of Rs. 10,000/- with one surety of like amount to the satisfaction of the concerned Investigating Officer and also subject to the following further conditions:- i.

At the time of furnishing bail bond, the petitioner shall provide the mobile number, which he undertakes to keep operational at all times during the pendency of the trial.

ii.

The petitioner shall inform the concerned Investigating Officer about his current residential address.

iii.

In case of change of residential addresses/contact details, the petitioner shall promptly inform the concerned Investigating Officer/SHO. iv.

The petitioner shall join the investigation as and when asked. v.

The petitioner shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.

vi.

The petitioner shall regularly appear before the trial Court. 12.

Nothing observed hereinabove shall amount to an expression on the merits of the case and shall not have a bearing on the trial of the case as the same has been expressed only for the purpose of the disposal of the present petition. 13.

The petition is disposed of accordingly.
