Learned APP for the State submits that in the present appeal, the impugned order was passed by learned ACMM and therefore the appeal would lie before the Sessions Court under proviso to Section 372 Cr.PC. 4.

Learned counsel appearing for the appellant concedes that the present appeal inadvertently filed before this Court and prays that the same may be transferred to the concerned Sessions Court.

In view of the aforesaid, the Registry is directed to transfer the present appeal to the concerned Sessions Court where it shall be listed for directions on 12.01.2026.
