% 02.03.2020 CM APPL. No. 8434/2020 (for directions) Respondent No. 2/NHAI seeks extension of time to comply with order dated 21.01.2020, whereby they were directed to refund the bank guarantee to the petitioner within four weeks. Counsel states that they are processing the return of the bank guarantee, which process requires certain internal approvals ; and that they undertake to comply with order dated 21.01.2020 within a period of three weeks from today. 2.

Learned counsel for the petitioner states that respondent No. 2 is already in breach of order dated 21.01.2020 ; apart from the fact that the petitioner is losing money by reason of the bank guarantee not having been refunded.

Be that as it may, one last opportunity is granted to respondent No. 2 to refund the bank guarantee positively within three weeks from today, failing which the bank guarantee amount will attract an interest @ 8% per annum, for the period of delay beyond the said three weeks. 4.

The application stands disposed of.

For the record, the petition already stands disposed of by order dated 21.01.2020.
