..... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 16.12.2019 CRL.M.A. 42784/2019 1.

Allowed, subject to all just exceptions.

W.P.(CRL) 3496/2019 2.

The petitioner has filed the present petition, inter alia, praying as under:- "It is, therefore, most humble and graciously prayed to this Hon'ble Court that this Hon'ble Court may be kindly pleased to issue writ/ order/ direction in the nature of mandamus directing the Respondent No. 1 & 2 to dispose of/decide the complaint of the petitioner in accordance with Rule 21 of Central Civil Service (Conduct) Rule, 1964, within one month/earliest possible, in the interest of justice."

3.

The petitioner claims to be the wife of respondent no.3. She has alleged that respondent no.3 has committed a fraud. In addition to the above, there are certain other allegations made against respondent no.3. Given the limited scope of the relief sought by the petitioner, this Court does not consider it apposite to examine the prayers made in the present petition. The learned counsel appearing for respondent nos.1 and 2 states that one of the complaints have been received. However, the complaint allegedly made in November, 2018 has not been received. In view of the above, this Court considers it apposite to direct respondent nos.1 and 2 to consider the present petition as a representation/complaint and take such steps as respondent nos.1 and 2 consider necessary in accordance with law. 4.

It is clarified that this Court has not expressed any opinion on the merits or maintainability of the complaint. The competent authority shall take such steps as it thinks fit.

5.

The petition is disposed of in the aforesaid terms. VIBHU BAKHRU, J DECEMBER 16, 2019 MK
