Mr. Jain, learned counsel for the respondent, has returned with instructions.
1.1 Learned counsel says that he has no difficulty if this Court were to appoint an independent Arbitrator in the matter. 2.
Accordingly, Mr. Y.D. Nagar, advocate, (Cell no.:9971310121) is appointed as an Arbitrator in the matter.

The learned Arbitrator will be paid his fee as per the provisions of the Fourth Schedule appended to the Arbitration and Conciliation Act, 1996 (for short '1996 Act').

The learned Arbitrator, before entering upon reference, will file a declaration in terms of Section 12(5) read with the attendant provisions of the 1996 Act.
