superstructure/building which had been given to the Respondent in the year 1969-71 at institutional rates of Rs. 1 lakh per acre. 2.

Material on record indicates that the decision was taken by the members of the Executive Committee of Jawaharlal Nehru National Youth Centre in its meeting dated 21.11.2023 had unanimously resolved to request the government to take over the entire land.

When this Court suggested to learned Counsel for the Petitioner that since the challenge is towards the decision taken by the Executive Committee and the handing over of a Note to the Department, the matter might require evidence and that the correct forum would be to file a suit, learned Counsel for the Petitioner accepted the suggestion given by the Court and seeks permission to withdraw the present writ petition with liberty to file a suit.

Permission and liberty, as sought for, is granted. 5.

It is made clear that this Court has not made any observations on the merits of the case.

The writ petition is disposed of as withdrawn along with pending application(s), if any.
