Mr. Srivastava, the learned counsel for the State accepts notice. At joint request, the case is taken up for disposal.
It is the petitioner's case that the jurisdiction for adjudication of the case bearing C.C.No.6725/2016, pending adjudication before the learned Metropolitan Magistrate (MM), North-West District, Rohini Courts, Delhi, would lie with the corresponding court in the North District of Rohini Courts. The learned counsel for the petitioner submits that notice has not yet been issued in the complaint case. Hence, the aforesaid case may be transferred to the latter District.
The learned counsel for the State submits upon instructions that since the facts and circumstances of the case relate to the North District, the matter would accordingly be triable by the corresponding court in the North District. In the aforesaid circumstances, C.C.No.6725/2016, pending adjudication before the learned MM, North-West District, Rohini Courts, Delhi, is transferred to the Court of the learned MM in the North District, Rohini Court, Delhi. The parties shall appear before the learned District Judge, North District, Rohini Courts, Delhi, on 31.01.2019, who shall assign the case to the relevant Court.
The petition stands disposed-off in terms of the above. NAJMI WAZIRI, J.
