After some arguments, learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application, with liberty to move an application under Section 438 of the Code of Criminal procedure, 1973 before the Sessions Court. 2.

Accordingly, the anticipatory bail application is dismissed as withdrawn, with liberty as prayed. However, it is clarified that this Court has not expressed any opinion on the merits of the anticipatory bail application.
