By way of the present application, the applicant seeks grant of regular bail in case arising out of FIR bearing no. 31/2025, registered at Police Station Special Cell, New Delhi for the commission of offences punishable under Sections 318(4)/61(2)(A)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS') and Section 66D/66C of Information Technology Act, 2000 (hereafter 'IT Act').

Briefly stated, the facts of the present case are that upon receipt of a complaint at the ISO Office, Dwarka, the present FIR came to be registered after an inquiry conducted under the aforesaid sections. Prior to the registration of the FIR, a complaint had been lodged on the NCRP portal bearing No. 30801250005746. During investigation, it was found that a total cheated amount of ₹1,22,30,475/- was transferred to seven accounts at the first layer and thereafter to twenty-nine accounts at the second layer, and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The statements of the complainant as well as concerned bank officials were recorded, and the bank accounts used in the commission of the offence were examined. Investigation revealed that on 02.02.2025, an amount of ₹21,38,475/- was credited from the account of the complainant and was immediately transferred to seven second-layer accounts. Similarly, on 04.01.2025, an amount of ₹8,00,000/- was credited from the complainant's account and was instantly transferred further to the second layer. On 20.08.2025, the accused, i.e., the present applicant, in respect of M/s Janseva Construction Account No. 224002000000527 maintained with Indian Overseas Bank, was served with a notice under Section 35 of BNSS to appear and join the investigation on 08.09.2025. On 08.09.

2025, the present applicant joined the investigation and was interrogated. During interrogation, it is alleged that he failed to disclose any facts regarding the money credited into the said bank account of M/s Janseva Construction at Nanded, Maharashtra. He also did not disclose the names of any other suspects or co-accused, nor did he provide any information regarding the cheated amount. The applicant produced one keypad mobile phone bearing mobile number 7030666669, which was found to be linked with the said bank account. He consistently denied using any Android or iOS mobile phone. However, analysis of the CDR of the said mobile number revealed its usage in both Apple and Android devices. Upon further questioning, the applicant admitted that his Apple iPhone had been kept with one Sagar Ganesh Rao Mamidwar, resident of Dwarka, Delhi.

mobile phone, and SIM card. However, analysis of the CDR revealed that the same mobile phone was used by the applicant subsequently, despite his claim that it had been stolen. The mobile phone was recovered, and the applicant was arrested on 08.09.2025. Analysis of the seized mobile phone revealed several chats and Telegram groups, which had been deleted. It is stated that efforts are being made to retrieve the deleted data and to identify other accused persons involved in the offence. Both the keypad phone and the Apple mobile phone were seized by the investigating agency. Further investigation revealed that the accused had opened a current account in the name of M/s Janseva Construction with Indian Overseas Bank, Nanded, Maharashtra on 04.12.2024, bearing Account No. 22400200000527. The accused and his wife, Anju Vijay Gore, were joint account holders of the said account. The mobile number 7030666669 was linked with the said account.

The learned counsel appearing on behalf of the applicant contends that the applicant has been falsely implicated in the present case, and has been in judicial custody since 08.09.2025. It is submitted that the applicant himself is a victim of cyber fraud allegedly committed by one Rahul, in respect of which a separate complaint had been lodged by the applicant. On these grounds, it is prayed that the applicant be granted regular bail. 4.

On the other hand, the learned APP for the State argues that the allegations against the present applicant are serious in nature and that he is directly involved in the cyber fraud conspiracy. This Court has heard arguments addressed on behalf of the applicant as well as the State, and has perused the material available on record. 6.

After hearing the arguments and perusing the case file, this Court is of the view that, as per the investigation, the present applicant is the account holder of the firm M/s Janseva Construction, having a current account with Indian Overseas Bank, Nanded, Maharashtra, bearing Account No. 22400200000527. The alleged transactions amounting to ₹29,38,475/- were credited into the said account on 02.01.2025 and 04.01.2025. This Court further notes that the mobile number 7030666669 was found to be linked with the said bank account, which was held jointly by the applicant and his wife.

During investigation, the mobile phone and SIM card linked with the said account were seized, which constitute incriminating material against the present applicant. It is further on record that a cheque book of the said account bearing Serial Nos. 503501 to 503550 and an ATM card of Indian Overseas Bank bearing No. 4712462500564615 were found in the name of the applicant.

The investigation has also revealed that as many as seven other complaints are registered against the said bank account, which has been used for the commission of similar fraudulent transactions. Further, the CDR analysis shows that the present applicant and one Rahul were in constant contact, and their location was found to be the same in Assam on 02.01.2025 and 04.01.2025, i.e., the dates of the alleged transactions. reflects that the applicant had attempted to mislead the police by claiming that his bag, mobile phone, and SIM card had been stolen by the said Rahul, which stands contradicted by the investigation. 9.

Considering the overall facts and circumstances of the case, this Court finds that allegations against the present applicant are serious in nature, and in view of the fact that the investigation in the case is still at the initial stage, this Court finds no ground for grant of regular bail to the applicant, at this stage.

Accordingly, the present application stands dismissed. 11.

It is, however, clarified that nothing expressed herein above shall tantamount to an expression of opinion on merits of the case. 12.
