This is a bail application filed by the petitioner for extension of interim custody parole/bail parole for another period of four weeks from 14.11.2019.

Learned Senior Counsel for the petitioner, after some arguments, when this Court asked as to how the petitioner has been continuously granted and/or extended custody/bail parole a number of times for months together by the Trial Court and why he should not be lodged back to Tihar Jail, sought leave of the Court to withdraw the bail application for interim custody/bail parole, with liberty to file an application for interim custody/bail parole on the basis of fresh cause of action, if any, as per law before the Trial Court.

In view of the aforesaid, leave is granted to withdraw the present interim custody/bail parole application, with the liberty as prayed, subject to just exceptions. However, it is clarified that this Court is not expressing any opinion on the merits of any such application, if filed before the Trial Court. The Trial Court shall decide the same on its own merits in accordance with law. Accordingly, the present application for extension of interim custody/bail parole is dismissed as withdrawn.
